Claim Construction. Analysis of claims constrained by prior art and the written description with comprehensive and compelling documentation. Careful attention to what is and isn't equivalent to claim terms is another critical focus.
Infringement Proof/Disproof. Most patents are overbroad and can be dramatically trimmed in the process of claim construction if adequate support is provided. Successful claim construction will usually invalidate infringement contentions.
Invalidity Analysis. About half of patents are proved invalid in litigation. Overwhelming support can be obtained in many cases and careful, organized presentations of the invalidity case can cause opposition to settle.
Laboratory Confirmation and Testing. Optical and electronic testing, proof (or contradiction) of concept, reduction to practice, reverse engineering, simulation and model building.
Patentability Analysis. Analysis of prior art, starting with patents and technical literature review. Inventions still determined worthwhile will be reviewed for market need. Thereafter, suittable breadth of claim construction will be proposed.
